In order to implement the Opinions of the Ministry of Transport, the State Post Bureau, the National Development and Reform Commission, the Ministry of Human Resources and Social Security, the General Administration of Market Supervision of the Ministry of Commerce, and the Notice of the Office of the State Post Bureau of the General Office of the Ministry of Human Resources and Social Security on Promoting Grassroots Express outlets to Give Priority to Work-related Injury Insurance (No.101 [2021] of the Ministry of Human Resources and Social Security) Requirements, focus on solving the problem of work-related injury protection for courier groups, and promote the sustained and healthy development of the express delivery industry. Now, the relevant matters concerning giving priority to work-related injury insurance for grassroots express outlets in this city are notified as follows:
First, the scope of insurance
Express delivery enterprises within the administrative area of this Municipality shall participate in various social insurances according to law. Express delivery companies that use labor dispatch should urge labor dispatch companies to participate in social insurance according to law. For grass-roots express outlets with flexible employment and high mobility, express employees who are engaged in express delivery, sorting, transportation, delivery and inquiry services can give priority to industrial injury insurance.
Before the issuance of this notice, express delivery enterprises and grass-roots express outlets that have participated in various social insurances according to regulations are not included in the above-mentioned priority to participate in industrial injury insurance.
Second, the way to participate in insurance
Grass-roots express outlets that have obtained the express business license of the postal administration department and have the main qualification of the employer can directly apply for priority insurance for express employees according to regulations; In the postal administration department of this Municipality, the grass-roots express outlets that have been put on record at the express terminal outlets and do not have the qualification of the employer’s main body shall be given priority insurance by the enterprise legal person with the qualification of the express business license and the qualification of the employer’s main body, and in principle, they shall apply for insurance at the express business license or the enterprise registration place, and bear the employer’s responsibility for industrial injury insurance.
When the insured units go through the formalities of priority insurance, they shall go to the social security agency with the business license, express business license or the receipt for filing at the express terminal outlets and the Registration Form for Priority Participation in Work-related Injury Insurance Units at the Grass-roots Express outlets audited and confirmed by the postal administration department, and the details of the increase or decrease of the insured personnel, and the personnel shall be changed in time.
Third, the payment base and rate
Grassroots express outlets give priority to work-related injury insurance, and real-name monthly payment is implemented. Individuals do not pay work-related injury insurance premiums. It is difficult to calculate and pay work-related injury insurance premiums directly according to the total wages of grassroots express outlets, and the payment base can be approved according to the average salary of employees in full-caliber urban units in this municipality last year. The payment rate shall be implemented according to the benchmark rate of postal industry in the industrial injury risk category of this municipality.
Social insurance agencies shall do a good job in adjusting floating rates according to the measures for the administration of floating rates in this Municipality.
Fourth, the enjoyment of treatment
Grassroots express outlets in accordance with the provisions to participate in work-related injury insurance, the insured in the insurance payment period suffered from accidents or occupational diseases, the work-related injury identification, labor ability appraisal, work-related injury insurance benefits, etc., in accordance with the "Regulations on Work-related Injury Insurance" and the relevant provisions of this Municipality. Among them, the application for work-related injury identification and labor ability appraisal should be submitted to the district human resources and social security bureau and the district labor ability appraisal Committee where the insured unit is registered.
Express companies, grass-roots express outlets or express employees who cheat industrial injury insurance benefits by fraud, forgery of certification materials or other means shall be handled by the human and social departments in accordance with the Social Insurance Law of People’s Republic of China (PRC), Regulations on Industrial Injury Insurance and Several Provisions on the Implementation of the Regulations on Industrial Injury Insurance in Beijing.
V. Handling services
According to the characteristics of the express delivery industry, the municipal social insurance agency simplifies and optimizes the procedures of insurance registration and payment verification, and promotes online processing to facilitate the insured units to handle the procedures of industrial injury insurance in time.
The Municipal Postal Administration establishes a dynamic management mechanism for grass-roots express outlets and employees according to the object scope of giving priority to work-related injury insurance, and verifies that it conforms to the scope of grass-roots express outlets and express employees who give priority to work-related injury insurance. The audit results serve as the basis for social security agencies to handle insurance registration, change and cancellation, premium verification and other businesses.
Beijing Municipal Taxation Bureau shall do a good job in collecting work-related injury insurance premiums at grass-roots express outlets according to regulations.
VI. Job Requirements
(1) Do a good job in organization and implementation. The municipal people’s social department and the postal administration department should raise awareness, strengthen organizational leadership, simplify and optimize work procedures, earnestly implement the organization and implementation of work-related injury insurance for express delivery practitioners at grassroots express outlets, and strive to achieve full coverage as soon as possible; It is necessary to guide express delivery enterprises and grass-roots express outlets to actively carry out publicity and training on industrial injury insurance policies and work-related injury prevention, and constantly improve the awareness of legal rights protection and work-related injury prevention of express delivery employees.
(2) Compacting corporate responsibility. Express companies and grass-roots express outlets should strengthen the prevention of work-related injuries, standardize the employment of enterprises, participate in work-related injury insurance for express employees in a timely manner according to regulations, and be responsible for the legality and authenticity of the insured and their information. The municipal postal administration department should give full play to the role of the competent department of the industry, strengthen supervision and standardized management, incorporate the participation of express employees in work-related injury insurance into the scope of the construction of the industry credit system, and make timely notifications in the industry to guide and urge express delivery enterprises and grassroots express outlets to do a good job in the work-related injury insurance for express delivery employees. Encourage commercial insurance as a supplementary means of protection.
(3) Strengthen supervision and management. Municipal people’s social departments, postal administration departments and tax departments should strengthen coordination and cooperation, strengthen data sharing among departments, and continuously improve the reliability and applicability of data; It is necessary to further strengthen supervision and management, supervision and inspection, urge employers to participate in insurance according to law, and effectively protect the rights and interests of work-related injury insurance for express delivery employees.
This notice shall come into force as of October 1, 2022.
